Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Occasion Day (“Occasion Day,” the “Service,” “we,” “us,” or “our”), including our website, reminders, e-cards, and printed-and-mailed cards. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.

2. What the Service does

Occasion Day lets you track dates, receive reminders, send digital e-cards, and order physical greeting cards that are printed, machine-handwritten with a real pen, stamped, and mailed on your behalf. Physical cards are produced and shipped by a third-party fulfillment provider and delivered by postal carriers. We act as an intermediary that arranges printing and mailing; we are not the postal carrier and do not control delivery times.

3. Your account

We use passwordless (magic-link) sign-in. You are responsible for the email account associated with your Occasion Day account and for activity that occurs through your account. Notify us at hello@occasion.day if you believe your account has been compromised.

4. Orders, pricing, and payment

Prices are shown at the time of purchase and are computed by us; you are charged the amount displayed. Payments are processed by our payment processor (Stripe); we do not store full card numbers. À-la-carte cards are charged per order. Subscriptions renew annually until canceled. All amounts are in U.S. dollars. Taxes, where applicable, are your responsibility.

Automatic charges (business autopilot)

If you enable autopilot, you authorize us to automatically charge your saved payment method for each card that autopilot sends on your behalf, at the per-card price then in effect, without further action from you. You may set a monthly spending cap and may turn autopilot off at any time from your account; doing so stops future automatic charges but does not reverse cards already sent. It is your responsibility to keep a valid payment method on file.

5. Your content and recipient information

You retain ownership of the messages, names, addresses, and other information you provide (“Your Content”). You grant us a limited license to use, reproduce, print, and mail Your Content solely to provide the Service. You represent and warrant that:

  • You have the right to submit Your Content and to send cards to the recipients you designate;
  • You have the authority to provide any recipient’s personal information (such as name and mailing address) and to have a card sent to them;
  • Your Content does not violate any law or third-party right.

Acceptable use

You agree not to use the Service to create, send, or facilitate content that is:

  • unlawful, threatening, harassing, abusive, defamatory, or hateful;
  • infringing of intellectual-property, privacy, or publicity rights;
  • deceptive, fraudulent, or impersonating another person or entity;
  • bulk unsolicited mail to recipients who have not agreed to receive it, or otherwise in violation of anti-spam or telemarketing laws.

We may, at our sole discretion and without liability, refuse, cancel, or remove any order or content that we believe violates these Terms, and we may suspend or terminate accounts that do so.

6. Fulfillment, shipping, and delivery

We currently mail cards to addresses in the United States only. Delivery is performed by third-party printers and postal carriers. While we work to send cards with enough lead time to arrive around a requested date, we do not guarantee any specific delivery date and are not responsible for delays caused by carriers, weather, incorrect addresses, or events outside our control. You are responsible for the accuracy of the addresses you provide. See our Refund & Shipping Policy.

7. Cancellations and refunds

Because cards are custom-produced, a mailed-card order can be canceled only before it has been submitted to the printer; e-cards are delivered immediately and cannot be canceled. Our remedies for problems, and how to request a refund, are described in our Refund & Shipping Policy, which is incorporated into these Terms.

8. Third-party services

The Service relies on third parties, including our payment processor, print-and-mail fulfillment provider, email provider, and hosting and database providers. Your use of the Service may also be subject to those parties’ terms. We are not responsible for third-party acts or omissions.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that reminders or cards will always be delivered on time.

10. Limitation of liability

To the maximum extent permitted by law, Occasion Day will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amount you paid us for the order giving rise to the claim or twenty U.S. dollars (US$20).

11. Indemnification

You agree to indemnify and hold harmless Occasion Day from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (including payment obligations, disclaimers, limitations of liability, and indemnification) will survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the United States and the state in which the operator of Occasion Day is established, without regard to conflict-of-laws rules. You agree that any dispute will be resolved in the courts located in that jurisdiction, to the extent permitted by law.
